Following the previous hearing in Hull where he applied for an off-air and local-cable carriage station, the resulting decision denying a license seemed only based upon cable company assertions that it would be difficult to either find a cable channel or limit its distribution to the intended coverage area. 2)The opinions of the Commissioners opposing the application implied that an off-air only license would be acceptable, but the CRTC decision stopped short of issuing a licence for off-air only, presumably because such was not applied for. The opinion of the Commisioner who supported the application, along with the objections of the other Commisioners being based solely on the cable carriage issue implied a willingness of the CRTC to license an off-air only station. 3)Accordingly, Mr. Pachul continued to broadcast as an off-air station only, as the CRTC clearly offered no objections to such an undertaking. 4)Mr. Pachul has thus been able to prove a number of things: A) an ability to continue operating even under the most adverse of conditions; B) an ability to remain true to his pledge as to the type of programing to be offered; C) his fierce resolve to fight for what he believes in - community television; and D) the potential for a community station to operate in Toronto as an off-air station only, albeit perhaps with some difficulty in a heavily cabled City. 5)Based then on the foregoing then, I request that the CRTC provide Mr. Pachul with a license to operate a Community Television Station on UHF television channel 15, with no inference required of future obligation of local cable companies to carry the signal.
